Statement by Director Jim Warren:
Late today, the NC Utilities Commission ruled for Duke Energy in the test case where NC WARN has been selling solar power to the Faith Community Church in Greensboro.
The NCUC levied a fine against NC WARN of approximately $60,000 for selling power to the church, but suspended the fine (it is unclear what “suspended” means in this case) if we stop selling power and meet other conditions.
This case is going to court. In other states, regulators or courts have agreed that third-party financing of rooftop solar is permissible and in the public interest.
In this case, the NCUC declined to hold a hearing over the nine months since the case began despite widespread public interest and engagement among the faith community and the national solar industry.
The NCUC says only the Duke monopoly can sell electricity. We will have more to say after reviewing the 32-page order.
